An Act
prohibiting the display of materials harmful to minors.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1:
Chapter 272 of the General Laws is hereby amended by
inserting after section 30D the following section:-
Section 30E. Whoever displays material which is harmful in such a way that minors as a part of the invited general public will be exposed to view such material, provided, however, a person shall not be
deemed to have displayed material to minors if the lower 2/3 is not exposed to view and segregated in a manner that physically prohibits access to the material by minors or whoever allows a minor to view, with or without consideration and material which i
s harmful to minors shall be punished by imprisonment in a jail or house of correction for not more than 2 ½ years or by a fine of not more than $5,000 or both.
