An Act authorizing the city of Beverly to issue additional liquor licenses to Joseph A. Leone, d/b/a The Black Cow Restaurant, and to the American BBQ LLC d/b/a the American BBQ..

Be it enacted by t he Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding section 17 of chapter 138 of the General Laws, the licensing authority of the city of Beverly may grant an additional license for the sale of all alcoholic beverages to be drunk on the premises under Section 12 of chapter 138 to Joseph A. Leone, d/b/a The Black Cow, for a restaurant to be located at 1 Water Street in Beverly. The license shall be subject to al l of said chapter 138 except section 17.

SECTION 2. Notwithstanding section 17 of chapter 138 of the General Laws, the licensing authority of the city of Beverly may grant an additional license for the sale of wine and malt beverage only to be drunk on t he premises under Section 12 of chapter 138 to the American BBQ LLC d/b/a The American BBQ, 950 Cummings Center, Suite 96X, in Beverly. The licenses shall be subject to all of said chapter 138 except section 17.

SECTION 3. Notwithstanding any general or special law or any rule or regulation to the contrary, the local alcohol licensing authority shall not approve the transfer of any of said licenses to any other locations. Said licenses may be granted by the local alcohol licensing authority at the same location if an applicant for said license files with said authority a letter in writing from the department of revenue indicating that said license is in good standing with said department and that any and all applicable taxes have been paid. If either of the licenses granted under this section are cancelled, revoked or no longer in use, such licenses shall be returned physically, with all of the legal rights, privileges and restriction pertaining thereto, to the local alcohol licensing authority.

SECTION 4. Notwithstanding section 17 of chapter 138 of the General Laws, or any other general or special law to the contrary, the local alcohol licensing authority may then grant the license to a new applicant at the same location and under the same conditions as specified in the preceding paragraph.

SECTION 5. This act shall take effect upon its passage.
