To the Honorable Senate and House of Representatives:
Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Validating
The Actions Taken At An Annual Town Election In The Town Of
Concord.”
Senator Fargo, Representative Atkins and the Concord Board of Selectmen have asked that this legislation be filed to ratify and validate the town’s March 31, 2009, annual town election, and subsequent actions taken in reliance on the election. Absent this legislation, the town would likely be forced to hold a costly special election or to fund its share of a school improvement project without the benefit of additional revenue from the override vote.

An Act Validating
The
Actions Taken At An Annual Town Election In The Town Of Concord.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the
authority of the same, as follows:
Notwithstanding section 64 of chapter 54 of the General Laws or any other general or special law or by-law to the contrary, the votes taken by the town of Concord at its March 31, 2009 annual town election and all actions taken pursuant thereto, are hereby ratified, validated and confirmed, notwithstanding any defect or
omisison
with regard to the warrant for said election.
SECTION 2.
This act shall take effect upon its passage.
