To the Honorable Senate and House of Representatives:

Pursuant to Section 5 of Article 63 of the Amendments to the Constitution, I am today signing House Bill 4759, “An Act Making Appropriations for the Fiscal Year 2010 to Provide for Supplementing Certain Existing Appropriations and for Certain Other Activities and Projects”, while disapproving certain items and returning one section for amendment.  

This legislation is necessary to maintain critical services through the remainder of this fiscal year for core safety net programs , to fund recently ratified collective bargaining agreements , and to provide for unavoidable and unanticipated costs , including emergency responses to recent incidents.   We have identified sufficient resources to support this necessary spending .

For largely technical reasons, however, I must disapprove a few items.   Because the Bristol Sheriff’s office has advised us that the appropriated funds are not needed, I disapprove item 8910-8300 in Section 2.  Because the collective bargaining agreement has not yet been ratified, I disapprove item 1599-4305 in Section 2A.  Because the items appropriate funds to federal grant and capital accounts that cannot receive state operating funds, I disapprove item 2840-7014 in Section 2, and items 4510-0404 , 4510-0639 , 4512-0102 , 4512-0179 , 4513-9018 , 4513-9035 , 4513-0115 , and 4516-1021 in Section 2D.  I am prepared under appropriate circumstances to approve corrected versions of the latter appropriations.

By separate letter, under Article LVI, as amended by Article XC, Section 3 of the Amendments to the Constitution, I am also returning Section 4 for amendment , for reasons explained in that letter.

I approve the remainder of this Act.
