An Act AUTHORIZING THE TOWN OF MILLBURY TO ISSUE TWO (2) ADDITIONAL LIQUOR LICENSES.
Be it enacted by the Senate and House of Representatives in General Court
assembled, and by the authority of the same, as follows:
SECTION
1
.
(a)
Notwithstanding section
17 of chapter 138 of the Gen
eral Laws
, the licensing authority of the town of
Millbury
may grant
two (2) additional
license
s
for the sale of all alcoholic bev
erages to be drunk on the premises
pursuant to
s
ection 12 of
chapter 138 at
The Shoppes at Blackstone Valley, located on Route 146, 70 Worcester-Providence Turnpike, Millbury, Massachusetts, 01527
; as identified on
Map 44, lot 31 & Map 61 lot 14 of the Mil
lbury Assessors Maps)
.
A license granted under this section shall be subject to all of
said c
hapter 138 except
said s
ection 17.
(b)
Once issued, t
he licensing
authority
shall not approve the transfer of
the
license
issued under
this section to any other
location
, but it may grant the
license
to a new applicant
at the same location if
the
applicant files with
the authority
a letter from the
d
epartment of
r
evenue indicating that
the
license is in good standing with
the d
epartment and that all applicable
taxes have been paid.
(c) If
the
license granted under this section is cancelled, revoked or longer in use,
it shall
license shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing
authority which may then
grant the license to a new applicant at the same location under the same condition
s
as specified in
this section
.
