An Act relative to Farmers' Markets.


 

              Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.   Section 17B of chapter 130 of the general laws, as appearing in the 2006 official edition, is hereby amended by inserting, at the end thereof the following:-

“ ; provided further that the holder of a propagation permit, so-called, shall not be required to possess a commercial permit as provided by section 80 and shall further be allowed to sell shellfish grown under such permit at a farmers market registered by the department of agricultural resources ”

SECTION 2.   Section 80 of said chapter 130, as so appearing, is hereby amended, in line 14, by inserting after the words “ shellfish or marine worms ” the following:-

“ or unless he is the holder of an aquaculture propagation permit as provided in section 17B ” .

SECTION 3.   Said section 80 of said chapter 130, as so appearing, is hereby amended, in line 28, by inserting after the words “ shall be exempt from obtaining a wholesale dealer permit; ” the following:-

“ ; and provided further that the holder of an aquaculture propagation permit as provided by section 17B shall be exempt from obtaining a wholesale dealer permit; ”

SECTION 4.   Said section 80 of said chapter 130, as so appearing, is hereby further amended, in line 36, by inserting after the words “ named on the permit; ” the following:-

“ ;provided further that the holder of an aquaculture propagation permit as provided by section 17B shall be permitted to sell shellfish grown under such permit at a farmers market that is registered by the department of agricultural resources; ”
