SECTION 1. Notwithstanding sections 40E through 40J, inclusive, of chapter 7 of the General Laws or any other general or special law to the contrary, the commissioner of capital asset management and maintenance, in consultation with the department of conservation and recreation, may convey to the town of South Hadley a certain parcel of land presently under the control of the department of conservation and recreation located in the town of South Hadley and shown as parcel 7-019 on the town of South Hadley assessor’s map 7, containing 1.06 acres. The town of South Hadley shall incorporate this parcel into the existing, adjacent parkland known as Buttery Brook Park. The consideration for the conveyance shall be nominal consideration as determined by the commissioner of capital asset management and maintenance, in consultation with the department of conservation and recreation. This parcel shall be conveyed by deed without warranties or representations by the commonwealth.
SECTION 2. Notwithstanding any general or special law to the contrary, the town of South Hadley shall be responsible for all costs and expenses, including but not limited to, costs associated with any engineering, surveys, and deed preparation related to the conveyance authorized pursuant to this act as such costs may be determined by the commissioner of capital asset management and maintenance, in consultation with the department of conservation and recreation.
