An Act amending the City of Gloucester charter. . Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: The charter of the city of Gloucester, which is on file in the office of the archivist of the commonwealth, as provided in section 12 of chapter 43B of the General Laws, is hereby amended by adding the following new subsection: Sec. 7-17. City Water Systems Ownership. Pursuant to the provisions of section 23-64 of the City of Gloucester Code of Ordinances (“Gloucester Public Water Systems Ordinance”), the City of Gloucester’s water supply and distribution system shall be owned by the City and shall not be sold, leased, or otherwise transferred unless and until the City Council, pursuant to the provisions of City Charter section 9-5 (“Submission of Proposed Measure to Voters”), submits the question of a sale, lease or transfer of ownership to a referendum vote of the voters for adoption or rejection, as provided in the applicable subsections of Article 9 of the City Charter. |
