An Act Bill relative to the town of Tisbury water supply system . Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: SECTION 1 Section 2 of Chapter 394 of the Acts of 1905 is hereby amended by striking from the first sentence the words ?the approval in writing of the state board of health? and inserting in their place the following words:- first obtaining the advice and approval of the department of environmental protection;. SECTION 2 Said Chapter 394 is hereby further amended by striking out Section 8 and inserting in place thereof the following section: Section 8 The water commissioners shall fix such prices or rates as may be necessary to defray annual operating expenses, interest charges and payments of principal, as they accrue, upon any bonds or notes issued for the purpose of the public water supply system. The town may provide for the operation of the public water supply system on the enterprise fund basis in accordance with section 53F1/2 of chapter 44 of the general laws. SECTION 3 Section 9 of said Chapter 394 is hereby amended by striking out the third sentence and inserting in place thereof the following sentence: Any vacancy occurring in the board shall be filled in the manner provided by Section 11 of Chapter 41 of the General Laws. SECTION 4 Said Section 9 of said Chapter 394 is hereby further amended by striking out the fifth sentence. SECTION 5 This act shall take effect upon its passage. |
