An Act relative to investigations by boards of registration in medicine, nursing and psychologists. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: SECTION 1. Chapter 112 of the General Laws is hereby amended by adding the following new section: Section 61A. Any privilege established by section twenty B of chapter two hundred thirty three, by court decision or by professional code relating to the exclusion of health information, including confidential communications, may not be invoked in any investigation of complaints or prosecution of disciplinary action by the board of registration in medicine, the board registration in nursing and, the board of registration of psychologists. All health information obtained by the board of registration in medicine, the board registration in nursing and, the board of registration of psychologists shall be maintained in accordance with chapter sixty-six A and chapter ninety-three H. Patient identities shall be impounded when such health information is used in any disciplinary action by the board of registration in medicine, the board registration in nursing and, the board of registration of psychologists. |
