The Commonwealth of Massachusetts
An Act relative to the requirements of telemarketers. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: SECTION 1. Section 5A of Chapter 159C of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after section 5A the following section:-
Section 5B. A telephone solicitor shall disclose the following information if contacting a consumer regarding fundraising efforts or sweepstakes: (i) the full and correct name of the company that employs them; (ii) the per dollar percentage of a donation that goes to the fundraising company and also to the donation recipient (iii) in the case of a sweepstakes the odds of winning the good or service.
Any violation of said section shall be a reason for the consumer to file a complaint with The Attorney General's Office.
