An Act relative to personal recognizance.. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: SECTION 1. Section 58 of chapter 276 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by adding the following paragraph:- Notwithstanding any general or special law, rule or regulation to the contrary, no person who has been previously convicted, without having that conviction vacated, of an offense involving the use or possession of a firearm, rifle, shotgun, machine gun, sawed-off shotgun, large capacity weapon or assault weapon as defined in section 121 of chapter 140 or a covert weapon as defined in section 131N of chapter 140, shall be eligible for release on personal recognizance without surety. |
