An Act relative to motor vehicle licenses of gang members. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: SECTION 1. Chapter 90 of the General Laws is hereby amended by inserting, after section 22F, the following section:- Section 22F ½ . A person shall be deemed a gang member when records maintained by the registrar, in conjunction with the police departments of the cities and towns or the state police, or any other law enforcement agency of the commonwealth, show that such person is a member of a gang because he has been assigned a score of 10 or more points by said police department or law enforcement agency in the following categories, including, but not limited to: self admission; known group tattoo marking; group related photo; or information from a reliable or confidential informant. The registrar shall, upon receiving the score assignment of 10 or more points for a person who is licensed to operate a motor vehicle under this chapter, notify said person of his designation as a gang member and issue a sticker bearing the letter “G” to said person and require him to put the sticker on his operator’s license. The registrar shall notify the state and local police departments of said designation. The registrar may suspend or revoke the license to operate of any person who is designated a gang member by the registrar and police department of a city or town or state police, or any other law enforcement agency of the commonwealth, if said person has committed a motor vehicle offense or has violated any provision of this chapter, while said designation is in effect. |
