3/25 /2010 To the Honorable Senate and House of Representatives: Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Relative to Certain Nomination Papers Filed in the Town of Millville.” Senator Moore, Representative Callahan and the Millville Board of Selectmen have requested that I file this special legislation on behalf of the Town to correct a discrepancy affecting their upcoming Annual Town Election. Based on a miscalculation, the Town Clerk set a nomination return deadline two days later than the statutorily mandated date and, as a result, several candidates filed their nominations papers late. This legislation will ensure that otherwise suitable candidates for municipal office are not disallowed to appear on the April 5, 2010 Annual Election ballot because of the Clerk’s clerical error. An Act relative to certain nomination papers filed in the town of Millville
.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
of the same, as follows:
SECTION 1 . Nomination papers for town officers submitted to the board of registrars in the town of Millville on or before the eighteenth day of February in the current year shall be valid, notwithstanding any failure to comply with section 7 of chapter 53 and section 4 of chapter 50 of the General Laws, which require that all such nomination papers shall be submitted to the registrars on or before 5:00 p.m. of the fourteenth day preceeding the day on which it must be filed with the town clerk, or any other applicable general or special law. SECTION 2. This act shall take effect upon its passage. |
