To the Honorable Senate and House of Representatives:

Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Making a Corrective Change Relative to the Town of Millbury and Payment of a Certain Bill.”  

              Pursuant to a request by Senator Moore, Representative Frost and the Millbury Board of Selectmen I filed and then signed special legislation on behalf of the Town to permit payment for completed municipal installation work in spite of the Town’s non-compliance with applicable procurement laws.  It subsequently came to my attention that there was a technical error in the enacted legislation – it was intended to authorize payment from the fiscal year 2009 appropriation, not FY 2010 as written in the bill.  I am therefore filing this legislation to correct the error and ensure that Millbury is able to pay its outstanding bills in a timely fashion.

An Act MAKING A CORRECTIVE CHANGE RELATIVE TO THE TOWN OF MILLBURY AND PAYMENT OF A CERTAIN BILL.


 

              Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1 .                 Section 1 of chapter 103 of the acts of 2010 is hereby amended by striking out the figure “2010” and inserting in place thereof the following figure :- 2009.

SECTION 2.   This act shall take effect upon its passage.
