7/15/2010 To the Honorable Senate and House of Representatives: Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Validating the Actions Taken at a Certain Town Election in the Town of Hopkinton.” Senator Spilka, Representative Dykema and the Hopkinton Board of Selectmen have requested that I file this legislation on behalf of the Town. The purpose of the legislation is to validate a vote taken on Question 2 at their Annual Town Election, held on May 17, 2010. Validation of the vote is necessary because the text of Question 2 was inadvertently left off the posted Annual Town Meeting Warrant. The question was, however, properly submitted for inclusion on the Town Meeting Hand Warrant and Town Election Ballot. This question, which received overwhelming support from the Town’s voters, permits the Town to borrow monies for the design of traffic, road and streetscape enhancements for the downtown area. Without this legislation the Town will be unable to begin this project, which has a scheduled release date of July 30, 2010 for the design RFP. An Act Validating the Actions Taken at a Certain Town Election in the Town of Hopkinton.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by th
e authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, all acts and proceedings taken by the town of Hopkinton at the town election held on May 17, 2010, and all actions taken pursuant thereto are hereby ratified, validated and confirmed, notwithstanding any defect or omission in the warrant or ballot for said election relative to the ballot question to exempt from provisions of proposition two and one-half, so-called, the amounts required to pay for the bond issued in order to pay for the design of traffic, roadway and streetscape enhancements in the downtown area of the Town. SECTION 2. This act shall take effect upon its passage |
