An Act relative to criminal penalties for resisting arrest.
 

              Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

              SECTION 1.  Section 32B of chapter 268 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by adding the following subsection:-

              (e) Whoever violates this section and causes serious bodily injury upon a police officer shall be punished by imprisonment in the state prison for not more than 5 years or in a jail or house of correction for not more than 2 1/2

              years, or by a fine of not more than $5,000.00, or by both such fine and imprisonment. For the purposes of this subsection, "serious bodily injury" shall mean bodily injury that results in a permanent disfigurement, loss or impairment of a bodily function, limb or organ, or a substantial risk of death.
