Whereas, The deferred operation of this act would tend to defeat its purpose, which is to immediately provide for civil penalties in relation to theft of electricity or gas, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
Section 127A of chapter 164 of the General Laws, inserted by section 1 of chapter 305 of the acts of 1982, is hereby amended by striking out the last sentence and inserting in place thereof the following sentence:- Any damages assessed under the provisions of this section in excess of the actual damages sustained by the corporation or person manufacturing, distributing or selling such electricity or gas shall be paid to the commonwealth; provided, however, that if a municipal lighting plant brings an action pursuant to this section such damages in excess of the actual damages shall be paid to such municipal lighting plant.
