CHAPTER 472 AN ACT ESTABLISHING A GRANT PROGRAM WITHIN THE DEPARTMENT OF ENVIRONMENTAL QUALITY ENGINEERING TO REMOVE INFILTRATION AND INFLOW FROM THE SEWERAGE SYSTEMS OF TOWNS, CITIES AND SEWERAGE DISTRICTS.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The first paragraph of section 12 of chapter 286 of the acts of 1982 is hereby amended by striking out the first sentence and inserting in place thereof the following sentence:- The division of water pollution control in the department of environmental quality engineering is hereby authorized and directed to expend a sum, not to exceed three hundred and fifty million dollars, for the purpose of carrying out the provisions of this section and of the Massachusetts Clean Waters Act, as set forth in section fifty-three of chapter twenty-one of the General Laws.

SECTION 2. Said section 12 of said chapter 286 is hereby further amended by adding the following paragraph:-

From funds made available by bonds issued pursuant to the provisions of sections twenty-one and twenty-two, said director is authorized to expend a sum, not to exceed one hundred million dollars, for the purpose of making grants to towns, cities and sewerage districts and to any public entity discharging thereto, for the purpose of construction projects to rehabilitate abatement facilities in order to remove infiltration and inflow therefrom. Such grants made by the division shall not exceed ninety per cent of the total eligible costs of such project, as determined by the division, and shall be made in accordance with eligibility criteria and a system of priority established by regulation adopted in accordance with section twenty-seven of chapter twenty-one of the General Laws. Of said one hundred million dollars the director is authorized to expend such portion of such sum, as he deems appropriate and necessary, as a grant or grants to the metropolitan district commission, for the purpose of funding a project or projects to study, design, construct, and conduct a program for monitoring, gauging and characterizing flows and volumes of wastewater in the metropolitan district sewer system and systems tributary thereto; and provided, further, that of said sum the director is also authorized to expend a sum, not to exceed one million dollars, for the purpose of funding a project or projects to assess and make evaluations and recommendations regarding the effectiveness of the grants and grant program authorized by this paragraph.

SECTION 3. Section 22 of said chapter 286 is hereby amended by striking out the first paragraph and inserting in place thereof the following paragraph:-

To meet the expenditure necessary in carrying out the provisions of this act, the state treasurer, upon the request of the governor, shall issue and sell bonds of the commonwealth to an amount in the aggregate not to exceed four hundred and thirty-three million two hundred and fifty thousand dollars, to be specified by the governor from time to time.

SECTION 4. Item 3722-9027 of section 2 of chapter 234 of the acts of 1984 is hereby amended by striking out, in line seventeen, the word "five" and inserting in place thereof the following word:- thirteen.
