CHAPTER 463 AN ACT RELATIVE TO THE EXAMINATION OF JURORS.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

The first paragraph of section 28 of chapter 234 of the General Laws, as appearing in the 1984 Official Edition, is hereby amended by adding the following two sentences:- In a criminal case such examination shall include questions designed to learn whether such juror understands that a defendant is presumed innocent until proven guilty, that the commonwealth has the burden of proving guilt beyond a reasonable doubt, and that the defendant need not present evidence in his behalf. If the court finds that such juror does not so understand, another shall be called in his stead.
