Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. For the purposes of section forty-two B of chapter seven of the General Laws, the deputy commissioner of the division of capital planning and operations is hereby authorized to design and construct the Massachusetts state track facility referred to in chapter seven hundred and seventy-two of the acts of nineteen hundred and eighty-seven in accordance with the alternate method recommended in a report filed with the general court entitled "Procedures for the Procurement of Design and Construction Services Under the Turnkey Method" and dated June thirteenth, nineteen hundred and eighty-eight.
SECTION 2. Notwithstanding the provisions of chapter seven hundred and seventy-two of the acts of nineteen hundred and eighty-seven, if the deputy commissioner is unable to acquire the parcel of land described in section one of said chapter seven hundred and seventy-two for the consideration stated therein, then the deputy commissioner is hereby authorized to withdraw from negotiations to purchase said parcel, and in lieu thereof, the deputy commissioner is hereby authorized to identify and convert to use for the site of the Massachusetts state track facility any existing surplus state property or alternatively to acquire other suitable publicly owned land for said purpose for a consideration not to exceed fair market value as determined by procedures customarily accepted by the appraising profession.
