Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Subsection (b) of section 3 of chapter 36 of the acts of 1976 is hereby amended by adding the following paragraph:-

(8) the unit that is an owner's principal residence, while vacated and rented by said owner for a period not to exceed two years, if said owner has not taken up residence elsewhere with the intention of not returning and has resided in the principal residence for at least two years immediately before vacating it.

SECTION 2. This act shall not apply to leases agreed to and tenancies created before the effective date of this act.
