Session Laws

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding the provisions of any general or special law to the contrary and in order to promote the public good, the state retirement board is hereby authorized and directed to retire Joseph E. McCain, Jr., a police officer of the metropolitan district commission police who, as a result of gunshot wounds and other injuries sustained while in the performance of his duties on January twenty-ninth, nineteen hundred and eighty-eight, is totally and permanently incapacitated for further service as a police officer, at a yearly amount of pension equal to the regular rate of compensation he would have been entitled to receive had he continued in service as a metropolitan district commission police officer at the grade held by him at the time of his retirement.

Said retirement shall become effective as of the date following the last day on which he is entitled to receive regular compensation.

SECTION 2. Upon the death of Joseph E. McCain, Jr., if Helen McCain his wife survives him, the state retirement board is authorized and directed to pay to her so long as she remains unmarried an annuity in the amount of three-fourths of the pension payable to him at the time of his death.

SECTION 3. Upon the retirement of Joseph E. McCain, Jr., the state retirement board shall forthwith pay him all amounts standing to his credit in the annuity savings fund of the state retirement system.

SECTION 4. The provisions of section one hundred of chapter forty-one of the General Laws shall continue to apply to said Joseph E. McCain, Jr. relative to his receiving such indemnification by said commission for all hospital, medical and related expenses that have been or may be incurred after the date of his retirement as a result of the aforementioned incapacity.

SECTION 5. This act shall take effect upon its passage.
