CHAPTER 98 AN ACT RELATIVE TO THE BOARD OF TRUSTEES FOR CERTAIN CEMETERIES IN THE CITY OF BROCKTON.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Chapter 94 of the Special Acts of 1919 is hereby amended by striking out sections 1 and 2 and inserting in place thereof the following two sections:-

Section 1. Melrose, Coweeset, West (Snell), Thayer, Thompson, First Parish, East Ashland Street, Melrose Avenue, Leach, and all after-acquired cemeteries in the city of Brockton shall be under the exclusive care, management, and control of the Brockton cemeteries' board of trustees who shall make such rules and regulations, not inconsistent with law, in relation to the use and management of the cemeteries as they shall deem necessary or expedient.

Section 2. Said board shall consist of six members to be appointed by the mayor, subject to confirmation by the city council. Each member shall be appointed to serve for the term of five years and until his successor is chosen and qualified. In addition to the six members to the board of trustees, the mayor shall be a member of the board ex officio and its chairman. Vacancies in the board arising from death, resignation, or otherwise, shall be filled for the unexpired term by mayoral appointment. No person shall be eligible to the office of trustee aforesaid unless he is a resident of the city of Brockton.

SECTION 2. Notwithstanding the provisions of section one, all trustees holding such positions on the effective date of this act shall continue to serve on the board until their present term expires and their successor is chosen and qualified, in the manner herein provided, or until a vacancy is created in such position by death, resignation or otherwise as aforesaid.
