CHAPTER 236 AN ACT AUTHORIZING THE CITY OF BOSTON TO TAKE AN EASEMENT IN TWO PARCELS OF PARK LAND AND TO CONVEY A CERTAIN PARCEL OF LAND IN THE CITY OF BOSTON.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The city of Boston, acting by and through its public improvement commission, is hereby authorized to take an easement in certain parcels of land currently under the control of the metropolitan district commission for park land purposes, in order to layout and alter Commercial street by widening that street at a point where it intersects North Washington street. Said parcels are shown on a plan dated September eleventh, nineteen hundred and ninety-one, and entitled "City of Boston, Public Works Department, Commercial Street, North Washington Street Plan, Gordon E. Barnes, Division Engineer for the Public Works Department, Public Works Commissioner Joseph F. Casazza", described as follows:

Parcel 1

Beginning at a point marking the junction of the northerly street line of North Washington Street and the northerly street line of Commercial Street as shown on said Plan; and thence running easterly by a curve of eighty-one (81.00) feet radius thirteen and 56/100 (13.56) feet; thence running by the northwesterly line of Commercial Street five and 01/100 (5.01) feet; thence running southwesterly by the remaining Metropolitan District Commission parcel fifteen and 24/100 (15.24) feet to the point of beginning. This parcel contains thirty-five (35) square feet, more or less.

Parcel 3

Beginning at a point in the northerly line of Commercial Street as shown on said Plan; and thence running northeasterly thirty-four 18/100 (34.18) feet; thence running northwesterly eight and 93/100 (8.93) feet; thence running southwesterly by the remaining Metropolitan District Commission parcel thirty-five and 44/100 (35.44) feet to the point of the beginning. This parcel contains one hundred and fifty-two (152) square feet, more or less.

SECTION 2. The city of Boston, acting by and through its public improvement commission, is hereby authorized to convey in fee, by deed approved as to form by the corporation counsel of the city of Boston and signed by the mayor of said city of Boston, a certain parcel of land as shown on the plan specified in section one to the commonwealth as compensation for the taking authorized in section one. The commonwealth is hereby authorized to acquire said parcel by deed approved as to form by the attorney general.

Said parcel is described as follows:

Parcel 2

Beginning at a point in the northwesterly and northerly street line of Commercial Street as shown on said Plan; and thence running by two dimensions, northeasterly nine and 02/100 (9.02) feet and twenty-nine and 79/100 (29.79) feet; thence running southwesterly by the northerly line of Commercial Street by two dimensions, southwesterly thirty-one 27/100 (31.27) feet and four and 30/100 (4.30) feet to the point of beginning. This parcel contains one hundred and thirty-four (134) feet, more or less.

SECTION 3. This act shall take effect upon its passage.
