CHAPTER 256 AN ACT PROVIDING FOR THE ABANDONMENT AND CONVEYANCE OF A RIGHT OF WAY IN THE CITY OF BROCKTON.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The commissioner of the division of capital planning and operations, in consultation with the Massachusetts higher education coordinating council, is hereby authorized, by deed or other instrument approved as to form by the attorney general, to abandon, release and convey to 843 Crescent Street Corp., a Massachusetts corporation, all right and interest the commonwealth has in a right of way in the city of Brockton, over Blanch Avenue and over a portion of the property presently owned by 843 Crescent Street Corp., no longer needed for access, travel or operation by Massasoit Community College. Said right of way is for the benefit of property described in a deed from the city of Brockton dated September twenty-seventh, nineteen hundred and sixty-eight, recorded with the Plymouth county registry of deeds, Book 3473, Page 593: and is more particularly described in a Grant of Easement from William W. Simmons to Josiah Q. Packard, recorded with said registry of deeds, Book 1398, Page 567. The abandonment, release and conveyance of said right of way shall be in accordance with such terms and conditions as the commissioner, in consultation with the Massachusetts higher education coordinating council, shall prescribe.

SECTION 2. The provisions of sections forty F, forty F>, and forty H of chapter seven of the General Laws shall not apply to the abandonment, release and conveyance of the right of way authorized by this act.
