Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
The commissioner of the division of capital planning and operations is hereby authorized, notwithstanding the provisions of section forty H and section forty I of chapter seven of the General Laws, to acquire by eminent domain under the provisions of chapter seventy-nine of the General Laws, or by purchase, gift or otherwise, and the town of Ashland is hereby authorized to convey to the commonwealth acting by and through the division of capital planning and operations, three parcels of land in said town of Ashland; provided, however, that if the acquisition is by purchase the purchase price for said property shall be based on an appraisal of the value of the property for highway use by a professional appraiser using professional appraising practices. Said parcels are owned by said town and are presently used for recreational purposes. Said parcels are to be diverted from their present use to a highway use. The parcels are shown as parcels 4-2, 4-T-1 and 4-WSD-1-T on a plan entitled, "Plan of Land Owned by the Town of Ashland showing Parcels Needed for Highway Purpose," dated January tenth, nineteen hundred and ninety-five, which shall be kept on file by the chief engineer of the department of highways.
