Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
The commissioner of the division of capital planning and operations is hereby authorized, notwithstanding the provisions of section forty H of chapter seven of the General Laws, to grant a permanent easement on a portion of land consisting of approximately three hundred square feet in the Hingham shipyard in the town of Hingham, now under the care and control of the department of environmental management to the Massachusetts Chapter of the United States LST Association for the purpose of erecting, maintaining, repairing and replacing a monument honoring those who served on landing ship tanks, in a location within said land to be shown on a plan prepared by said commissioner in consultation with said department. The consideration for said easement shall be the expenses of any nature and kind of the maintenance, management, repair, replacement and operation of said easement.
Said commissioner of the division of capital planning and operations, in consultation with the commissioner of the department of environmental management, shall reserve the right to move said monument to another location in said shipyard which is substantially as open and visible as the original location.
The Massachusetts Chapter of the United States LST Association shall be responsible for the erection, maintenance, repair and replacement of said monument and may have access thereto at reasonable times. Said chapter shall be responsible for all costs, liabilities and expenses of any nature and kind for the construction, development, maintenance, repair, replacement and operations in the easement area.
