Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. The commissioner of the division of capital planning and operations is hereby authorized, subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to acquire by eminent domain, purchase or otherwise from the city of Lowell, certain parcels of land owned by said city and described in section 2. Said parcels are to be diverted from park land use to highway use.
SECTION 2. The descriptions of the parcels referred to in section one are as follows:
Parcel No. 20-1 Beginning in the northeast corner of Shedd Park at the point defined by the intersection of Rogers Street and Boylston Street right of ways, continue southerly along said Boylston Street right of way for a distance of two thousand six hundred ninety-three and 96/100 feet (2,693.96') to a point on the B&M Railroad right of way defined as the parcel point of beginning. Double back along said Boylston Street right of way for a distance of thirteen feet plus or minus (13'+-) this point also being a corner point of parcel 20-4-C. Look back and turn an angle to the right of hundred thirteen degrees thirty-three minutes (113<=-33') and continue a distance of twenty-four feet plus or minus (24'+-). Look back and turn an angle to the right of sixty-six degrees twenty-five minutes (66<=-25') and continue a distance of ten feet plus or minus (10'+-) to said B&M railroad right of way. Follow along said B&M Railroad right of way easterly twenty-five feet plus or minus (25+-) to the parcel point of beginning. The enclosed area is about two hundred eighty-five square (285) square feet.
Parcel 20-4-C. Beginning in the northeast corner of Shedd Park at the point defined by the intersection of Rogers Street and Boylston Street right of ways, continue southerly along said Boylston Street right of way for a distance of two-thousand three hundred sixteen and 96/100 feet (2,316.96') to a point defined as the parcel point of beginning. Continue southerly along said Boylston Street right of way for a distance of three hundred sixty-four feet (364'). Look back and turn an angle to the left of sixty-six degrees twenty-seven minutes (66<=-27') and continue a distance of five feet plus or minus (5+-). Look back and turn an angle to the left of one hundred thirteen degrees fifty-seven minutes (113<=-57') continue a distance of two hundred thirty seven feet plus or minus (237+-). Look back and turn an angle to the left of one hundred seventy seven degrees thirty-one minutes (177<=-31'). Continue a distance of one hundred twenty-six feet plus or minus (126+-) to the parcel point of beginning. The enclosed area is about one thousand five hundred sixty (1,560) square feet.
The parcels of land, hereinbefore described, are shown on a plan entitled "PLAN OF LAND IN THE CITY OF LOWELL, MASSACHUSETTS MIDDLESEX COUNTY OWNED BY THE CITY OF LOWELL AND REQUIRED FOR HIGHWAY PURPOSES", dated June twentieth, nineteen hundred and ninety-four. This plan shall be kept on file with the chief engineer of the department of highways.
