Session Laws

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding the provisions of section forty H of chapter seven of the General Laws, the commissioner of the division of capital planning and operations is hereby authorized to acquire by purchase, or by eminent domain under the provisions of chapter seventy-nine of the General Laws, for use by the executive office of environmental affairs in the protection of the water resources of the commonwealth, and the Fitchburg redevelopment authority is hereby authorized to convey to the commonwealth acting by and through the division of capital planning and operations for such purpose, the land described in section two. The consideration for such acquisition shall be two million four hundred thousand dollars as authorized in item 2000-8963 of section two of chapter fifteen of the acts of nineteen hundred and ninety-five.

SECTION 2. The land to be acquired under the provisions of section one is described as follows:

Parcel 1. The parcel of land, excluding Parcel B-1 shown as Parcels, 1, 2, 10 and 11 on the plan titled "Plan of Property Prepared for City of Fitchburg Redevelopment Authority, Fitchburg, Massachusetts" dated September 7, 1994, recorded in the registry of deeds in the northern district of Worcester in Plan Book 375, Page 3, (the Title Plan) less.

Parcel 2. The parcel of land shown as Parcel B-1 on the plan titled "Plan of Land in Fitchburg, Mass., Prepared for Fitchburg Redevelopment Authority" dated August 10, 1994, recorded in said registry of deeds in Plan Book 375, Page 4, the B-1 Plan.

Parcel 3. The Second, Third, and Fourth parcels in Fitchburg Gas and Electric Light Company's deed to the grantor dated May 11, 1995, recorded in said registry of deeds in Book 2760, Page 16.

Parcel 1 conveyed hereunder shall be subject to the following conditions:-

(1) the power line, telephone and gas line easements Fitchburg Redevelopment Authority granted to Fitchburg Gas and Electric Light Company by the grant of easement dated May 11, 1995, recorded in said registry of deeds in Book 2720, Page 25;

(2) the access and utility easements Fitchburg Redevelopment Authority granted to Fitchburg Gas and Electric Light Company in the above mentioned deed for Parcel B-1 dated May 11, 1995, recorded in said registry of deeds in Book 2720, Page 31;

(3) the easement taken by the city of Fitchburg for the brick mill sewer line by the Order of Taking dated November 23, 1973, recorded in said registry of deeds in Book 1121, Page 469; and

(4) the power line easement granted by Carrie R. Winters to the Connecticut River Transmission Company by instrument dated March 8, 1909, recorded in said registry of deeds in Book 236, Page 592. With regard to said easement, see the note to title examiners in the grant of easement dated May 11, 1995, recorded in said registry of deeds in Book 2702, at Page 25.
