CHAPTER 414 AN ACT MAKING APPROPRIATIONS FOR THE FISCAL YEAR NINETEEN HUNDRED AND NINETY-SEVEN TO PROVIDE FOR SUPPLEMENTING CERTAIN EXISTING APPROPRIATIONS AND FOR CERTAIN OTHER ACTIVITIES AND PROJECTS.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. To provide for supplementing certain items in the general appropriations act and other appropriation acts for fiscal year nineteen hundred and ninety-seven and for certain other activities and projects in said fiscal year, the sums set forth in section two A are hereby appropriated from the General Fund unless specifically designated otherwise herein or in said appropriation acts, for the several purposes and subject to the conditions specified herein or in said appropriation acts, and subject to the provisions of law regulating the disbursement of public funds for the fiscal year ending June thirtieth, nineteen hundred and ninety-seven. Unless otherwise specified, the sums appropriated herein shall be in addition to any amounts previously appropriated and made available for the purposes of said items.

SECTION 2A. `tm;keep=no `tcol=6,B4;c1=1,9,tu,T;c2=1,78,tuc;c3=1,78,tuc;c4=12,52,tfh1;c5=16,49,tu;c6=65,13,tur `tc3 EXECUTIVE OFFICE FOR ADMINISTRATION AND FINANCE. `tc2 Reserves. `tc1 1599-3806 `tc4 For a reserve to meet the fiscal year nineteen hundred and ninety-six and nineteen hundred and ninety-seven costs of salary adjustments and other economic benefits authorized by the collective bargaining agreement between the commonwealth and the Coalition of Public Safety (Unit 5), and to meet the costs of salary adjustments and benefits necessary to provide equal salary adjustments and benefits to employees employed in "confidential" positions which otherwise would be covered by said collective bargaining agreement; provided, however, that the personnel administrator, with the approval of the secretary of administration and finance, shall determine such salary adjustments and benefits for such "confidential" employees in accordance with the provisions of the collective bargaining agreement then in effect which otherwise would cover said positions; provided, further, that said secretary is hereby authorized to transfer from the sum appropriated herein to other items of appropriation and allocations thereof for fiscal year nineteen hundred and ninety-seven such amounts as are necessary to meet the costs of said adjustments and benefits where the amounts otherwise available are insufficient for the purpose, in accordance with a transfer plan which shall be filed in advance with the house and senate committees on ways and means; and provided, further, that said secretary is hereby authorized to allocate the cost of said adjustments and benefits to the several state or other funds to which such items of appropriation are charged `tc6 $1,540,000 `tc1 1599-9989 `tc4 For a one-time reserve in anticipation of capital funding to meet the immediate operating costs of the government land bank for administration and the provision of municipal services for the Devens Regional Enterprise Zone pursuant to the provisions of chapter four hundred and ninety-eight of the acts of nineteen hundred and ninety-three; provided, however, that no funds shall be expended from this item until said government land bank files with the secretary of administration and finance and the house and senate committees on ways and means a financial plan detailing said costs and a schedule projecting the monthly allotment needed to meet said costs; provided, further, that the comptroller is hereby authorized and directed to transfer to said government land bank the monthly allotment amount specified by said schedule; and, provided further, that the General Fund shall be reimbursed any amounts expended from this item from monies generated by any capital outlay appropriations made on behalf of said government land bank for said Devens Regional Enterprise Zone after the effective date of this act `tc6 $3,750,000 `tc3 EXECUTIVE OFFICE OF EDUCATION. `tc2 Department of Education. `tc1 7061-0014 `tc4 For certain one-time costs to correct calculations for the distribution in chapter seventy school aid, so-called, as provided by section three of chapter one hundred and fifty-one of the acts of nineteen hundred and ninety-six; provided, however, that forty thousand four hundred eighty-eight dollars shall be expended for the town of Amherst; provided, further, that two thousand six hundred twenty-five dollars shall be expended for the town of Andover; provided, further, that twenty-seven thousand fifteen dollars shall be expended for the town of Ashfield; provided, further, that six hundred sixty-four dollars shall be expended for the city of Attleboro; provided, further, that seventy-eight thousand seventeen dollars shall be expended for the town of Belchertown; provided, further, that two hundred three thousand seven hundred fourteen dollars shall be expended for the town of Billerica; provided, further, that seven hundred ninety-four thousand two hundred twenty-three dollars shall be expended for the city of Boston; provided, further, that one thousand one hundred twenty-two dollars shall be expended for the town of Brimfield; provided, further, that seventy-one thousand five hundred twenty-one dollars shall be expended for the city of Brockton; provided, further, that eight thousand seven hundred sixty dollars shall be expended for the town of Carver; provided, further, that fifteen thousand one hundred seventy-three dollars shall be expended for the town of Charlemont; provided, further, that three thousand two hundred two dollars shall be expended for the town of Clarksburg; provided, further, that one hundred sixty-three thousand seven hundred one dollars shall be expended for the city of Fall River; provided, further, that three thousand seven hundred sixty-eight dollars shall be expended for the town of Falmouth; provided, further, that one hundred forty-six thousand one hundred twenty-four dollars shall be expended for the city of Fitchburg; provided, further, that nine thousand two hundred three dollars shall be expended for the town of Hawley; provided, further, that sixty-nine thousand four hundred fifty-three dollars shall be expended for the town of Hingham; provided, further, that one thousand five hundred twenty-seven dollars shall be expended for the town of Holland; provided, further, that sixty-three thousand seven hundred forty dollars shall be expended for the city of Lawrence; provided, further, that three thousand five hundred thirty-six dollars shall be expended for the town of Leverett; provided, further, that eleven thousand one dollars shall be expended for the town of Lunenburg; provided, further, that five hundred eighteen thousand seven hundred fifty-two dollars shall be expended for the city of Lynn; provided, further, that one hundred ninety-five thousand six hundred ninety-four dollars shall be expended for the city of Malden; provided, further, that four thousand eight hundred two dollars shall be expended for the town of Pelham; provided, further, that fifty-two thousand six hundred eight dollars shall be expended for the city of Revere; provided, further, that four hundred twelve dollars shall be expended for the city of Salem; provided, further, that two hundred six thousand two hundred thirty-two dollars shall be expended for the city of Springfield; provided, further, that six hundred twenty-eight dollars shall be expended for the town of Sunderland; provided, further, that one hundred fifty dollars shall be expended for the town of Tyringham; provided, further, that one thousand fifty-nine dollars shall be expended for the town of Wales; provided, further, that twenty-three thousand seventy-five dollars shall be expended for the Amherst-Pelham Regional School District; provided, further, that one hundred ninety-seven thousand one hundred fifty dollars shall be expended for the Dennis-Yarmouth Regional School District; provided, further, that twenty-nine thousand nine hundred five dollars shall be expended for the Gill-Montague Regional School District; provided, further, that one thousand one hundred eighteen dollars shall be expended for the Hampshire Regional School District; provided, further, that five hundred seventy-four dollars shall be expended for the New Salem-Wendell Regional School District; provided, further, that eleven thousand five hundred fifty-nine dollars shall be expended for the Ralph C. Mahar Regional School District; provided, further, that seven thousand eighty-nine dollars shall be expended for the Tantasqua Regional School District; provided, further, that thirty-one thousand two dollars shall be expended for the North Shore Regional School District; provided, further, that three thousand six hundred fifty dollars shall be expended for the Southern Worcester Regional School District; and provided, further, that two thousand forty-nine dollars shall be expended for the Essex County Regional School District `tc6 $3,006,105 `tc5 Local Aid Fund 100.0% `tcol;end

SECTION 3. Item 7061-0011 of section 2 of chapter 151 of the acts of 1996 is hereby amended by striking out the words "; provided, further, that not less than two hundred and sixteen thousand one hundred and seventy-four dollars shall be expended for the Dennis Yarmouth Regional School District", as appearing in section 116 of chapter 204 of the acts of 1996, and inserting in place thereof the following words:- provided, further, that not less than nineteen thousand twenty-four dollars shall be expended for Dennis Yarmouth regional school district.

SECTION 4. Said section 2 of said chapter 151 is hereby further amended by striking out item 7061-9010 and inserting in place thereof the following item:- `tm;keep=no `tcol=6,B4;c1=1,9,tu,T;c2=1,78,tuc;c3=1,78,tuc;c4=12,52,tfh1;c5=16,49,tu;c6=65,13,tur `tc1 7061-9010 `tc4 For fiscal year nineteen hundred and ninety-seven reimbursements to certain cities, towns and regional school districts pursuant to section nineteen of chapter two hundred and sixty-seven of the acts of nineteen hundred and ninety-five; provided, further, that one hundred and twenty-nine thousand four hundred ninety-six dollars shall be expended for below foundation school choice reimbursements to the town of Shirley; and provided, further, that three hundred sixty-four thousand dollars shall be expended for below foundation charter school reimbursements to the city of Medford `tc6 $2,415,461 `tc5 Local Aid Fund 100.0% `tcol;end

SECTION 5. Section 166 of chapter 204 of the acts of 1996 is hereby amended by striking out the line reading "Brookline 22,156" and inserting in place thereof the following line:- Brookline 127,155.

SECTION 6. Notwithstanding the provisions of any general or special law to the contrary, an amount not to exceed four hundred sixty-seven thousand three hundred thirty-two dollars and seventy-five cents of the balance from item 1599-3750 of section two A of chapter thirty-nine of the acts of nineteen hundred and ninety-five which otherwise would have reverted as of June thirtieth, nineteen hundred and ninety-six, shall remain available for expenditure until June thirtieth, nineteen hundred and ninety-seven.

SECTION 7. For the purposes of calculating chapter seventy school aid, so-called, for fiscal year nineteen hundred and ninety-eight, the amounts delineated below shall be considered as the fiscal year nineteen SECTION 8. This act shall take effect upon its passage.
