CHAPTER 446 AN ACT AUTHORIZING THE NEWTON HOUSING AUTHORITY TO SELL A CERTAIN PARCEL OF LAND AND THE BUILDINGS THEREON.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding the provisions of any general or special law to the contrary, and subject to approval of the department of housing and community development, the Newton Housing Authority is hereby authorized to negotiate a contract for sale and to sell to Newton-Wellesley-Weston Committee for Community Living, Inc., a charitable corporation organized under the laws of the commonwealth, the land and buildings thereon in the city of Newton, described in a deed dated December 5, 1984, recorded in the southern district of Middlesex county, registry of deeds in Book 15917, Page 527, for the fair market value thereof as determined by said department, but not for less than the amount necessary to pay in full the principal of and interest on the outstanding obligations of said housing authority with respect to said property, said real property to be used for the civic purpose of providing housing for handicapped persons of low income; provided that the deed conveying said land and buildings shall include a restrictive covenant restricting occupancy of the property to handicapped persons of low income as defined under applicable federal or state law.

SECTION 2. This act shall take effect upon its passage.
