Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Chapter 71 of the General Laws is hereby amended by inserting after section 38Q the following section:-

Section 38R. The school committee and superintendent of any city, town or regional school district and the principal, by whatever title the position be known, of a public school of any city, town or regional school district shall have access to criminal offender record information of any applicant for any position in the school department, including any subcontractor or laborer commissioned by the school committee of any city, town or regional school district to perform work on school grounds during any time where there may be direct contact with school children, where applicable for hiring purposes. Such access shall be exercised in accordance with sections one hundred and sixty-seven to one hundred and seventy-eight, inclusive, of chapter six.
