Session Laws

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding the provisions of sections fourteen and thirty-four of chapter ninety-one of the General Laws or any other general or special law to the contrary, the department of environmental protection is hereby authorized to grant, deny or condition a license to the Crescent Yacht Club in the city of Haverhill to place, maintain and repair a floating barge, to be known as the Crescent Yacht Club Floating Dock, secured by piles, to be located in whole or in part beyond the harbor line in the vicinity of the downtown Haverhill area near the Ralph T. Basiliere bridge, such harbor line having been established in prior acts, including chapter five hundred and six of the acts of nineteen hundred and fourteen; provided, however, that no license issued by the department of environmental protection for the Crescent Yacht Club Floating Dock shall be for a term longer than ninety-nine years, but this shall not restrict the ability of said department to issue successive licenses for such floating barge. Said Crescent Yacht Club Floating Dock shall be restricted in size to a maximum of six and one-half feet wide and two hundred feet long, and shall be connected to the existing wharf by such other connecting docks as may be necessary. Nothing in this section shall be construed as exempting said project from all substantive and procedural requirements of said chapter ninety-one and regulations promulgated thereunder, other than the exception permitted herein from the harbor line requirements of said sections fourteen and thirty-four of said chapter ninety-one.

SECTION 2. The approximate location of the exception to the harbor lines hereby established shall be shown on a plan entitled, "The Establishment of Exceptions to the Harbor Lines at Crescent Yacht Club", and bearing the effective date of this act. A final plan showing the specific location of said project shall be incorporated in the waterways license to be issued subsequent to said effective date. Both plans shall be prepared for the department of environmental protection, maintained by and in said department, and made available for public inspection.

SECTION 3. This act shall take effect upon its passage.
