Whereas , The deferred operation of this act would tend to defeat its
purpose, which is forthwith to regulate further the licensing of certain home
inspectors, therefore it is hereby declared to be an emergency law, necessary
for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1.
Section 4 of chapter 146
of the acts of 1999 is hereby
amended by striking out, in line 1, the words "Prior to May 1, 2001" and
inserting in place thereof the following words:- Before November 1, 2001.
SECTION 2.
Said section 4 of said chapter 146 is hereby further
amended by adding the following paragraph:-
Before November 1, 2001, the board shall issue to an individual, upon
application, a temporary home inspector license if the applicant meets the
requirements of clauses (i) and (v) of subsection (d) of section 202 of
chapter 112 of the General Laws and: (1) has been engaged in the practice of
home inspection for compensation for not less than 3 years before the
effective
date of this act and has performed not less than 100 home inspections for
compensation; or (2) has been engaged in the practice of home inspection for
compensation for not less than 1 year before the effective date of this act
and has performed not less than 125 home
inspections for compensation. A temporary home inspector license shall
terminate in 90 days or whenever the applicant furnishes the board with proof
of having passed a licensing examination approved by the board, whichever first
occurs. The board shall issue a home inspector license to a holder of a
temporary license who furnishes such proof of having passed a licensing
examination.
