Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1.
The first paragraph of clause (a) of
section 3 of
chapter 397 of the
acts of 1978, as amended by chapter 38 of the acts of 1988, is
hereby further amended by striking out, in line 2, the words "not
inconsistent with general law" and inserting in place thereof the following
words:- in a manner
consistent with the General Laws.
SECTION 2.
Said first paragraph of said
clause (a) of said
section 3 of said chapter 397, is hereby further amended
by striking out the third and fourth sentences and inserting
in
place thereof the following 3 sentences:- The traffic commission may, with
the approval of
the mayor and board of aldermen, prescribe fines for violations of rules or
regulations adopted under this chapter excluding snow emergency parking
violations as described in this paragraph; provided, however, that no penalty
in
excess of
$30 shall be imposed except by ordinance. The traffic commission
may,
with the approval of the mayor and the board of aldermen, prescribe a schedule
of
fines for the following snow emergency parking violations: parking within
20 feet of an intersection, parking within the area of a fire hydrant and
parking
within designated fire lanes; provided, however, that no penalty in excess of
$50
shall be imposed except by ordinance. A penalty imposed under this
section may, if provided in the regulations imposing penalties, be increased
by up to 17 per cent if paid later than 21 days after the
issuance
of a notice of a parking violation but before the parking clerk reports to the
registrar in accordance with section 20A> of chapter 90 of
the
General Laws and 67 per cent if paid thereafter.
SECTION 3.
Clause (f) of said section 3 of said
chapter 397
is
hereby amended by striking out, in line 16, the words "section
twenty C of chapter ninety" and inserting in place thereof
the following words:- section 20A½ of chapter 90.
