Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1.
Notwithstanding any general or special law to the
contrary, the state board of retirement shall allow Joseph McMann, a retired
member of the trial court, the option to receive an ordinary disability
retirement under section 6 of chapter 32 of the General Laws. If Joseph
McMann notifies the retirement board that he chooses to receive the ordinary
disability retirement, it shall become effective only if the board determines
that Joseph McMann's medical condition would entitle him to an ordinary
disability retirement, and the retirement board shall pay Joseph McMann
ordinary disability retirement benefits as of the effective date of this act
for the remainder of his retirement. Joseph McMann shall notify the board of
his decision on the option granted by this act within 90 days after the
effective date of this act.
SECTION 2.
This act shall take effect upon its passage.
