Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. The city of Chicopee, acting by and through the city council
and with the approval of the mayor, may convey 2 parcels of land, located in
the
city, to William L. and Mary Couture and Paul M. and Kathleen Olbrych. Parcel
A shall be conveyed to William L. and Mary Couture and Parcel B shall be
conveyed to Paul M. and Kathleen Olbrych and their successors.
The parcels are recorded in book 1634, Pages 371 and book 1635, pages 329
through 331 with the Hampden
county registry of deeds and are shown as Parcel A and Parcel B on the plan of
land entitled "Proposed Partial Abandonment of Szot Park Property 57 & 67
Academy Street" dated May 20, 2003.
SECTION 2.
The consideration for the conveyances authorized by this
act shall be the full and fair market value of the property based upon an
independent professional appraisal and shall be paid by the recipients to the
city of Chicopee. The proceeds of the conveyances shall be used for
conservation or recreation purposes.
SECTION 3.
The recipients of the parcels shall pay for all expenses
associated with any land survey, appraisal, title examinations, recording fees
and any other expenses relating to the conveyances of the parcel, and shall be
responsible for all costs, liabilities and expenses of any nature and kind of
its ownership. The recipients shall acquire the property in their present
condition without warranty.
SECTION 4.
This act shall take effect upon its passage.
